TERMS & CONDITIONS OF SALE

1. These conditions of sale shall form a binding agreement between Claremont Group Pty Ltd Trading as ABC Tarps (the “vendor”) and the purchaser referred to on the front of the tax invoice.
2. The vendor does not warrant that the tarpaulin supplied is suitable for any particular use.
3. The purchaser warrants that they have properly inspected the tarpaulin prior to use including:-
   (a) Carefully checking size before unpacking, the purchaser acknowledges that the tarpaulins cannot be returned unless faulty; and
   (b) Carefully check tarpaulin for faults immediately after unpacking. Use of a faulty tarpaulin voids any subsequent claim.
4. The purchaser further warrants and acknowledges that the use of its tarpaulin for any specific use is based on its own judgment as to the suitability of the tarpaulin supplied and further acknowledges that the vendor has not warranted and provided any warranty whatsoever as to the product apart from the limited warranty provided to specific tarpaulins referred to in the Dura-Tarp warranty below.
5. The vendor’s liability shall be limited to the cost of the tarpaulin supplied.
6. Unless otherwise agreed in writing all tarpaulins shall be at the purchaser’s risk upon delivery to the purchaser, its carrier or agent.
7. Tarpaulins supplied do not pass in property to the purchaser until paid in full to the vendor.

WARNING: THIS PRODUCT IS NOT RECOMMENDED TO BE USED AS EITHER A PERMANENT ROOF OR TEMPORARY ROOF ON OPEN STRUCTURES.

Claremont Group Pty Ltd trading as ABC Tarps (the “vendor”) does not represent in anyway that the product referred to above will meet any specific standard in performance or capacity. The vendor shall not be held liable for any damage or loss whatsoever occasioned from the failure of the product meeting standards complying with the requirements of use of the purchaser or any third party thereof.

DURA TARP WARRANTY CONDITIONS:

1. The vendor provides limited product warranty for the following products: Dura-Tarp 4000 12 months, Dura-Tarp 5000 - 18 months
2. This warranty is only valid for consumer purchase, where a tarpaulin is sold for commercial application; the warranty shall be limited to a period for 3 months from the date of purchase as provided for under legislation.
3. The warranty covers the replacement of the tarpaulin during the warranty period should it fail due to UV degradation.
4. The warranty does not apply to any tarpaulin that has been subject to accident, misuse, neglect, corrosive chemicals, extreme weather conditions, normal wear and tear, shipment, causes external to the tarpaulin or where recommendations below have not been followed.
5. The vendor shall not be liable for:
   (a) Damage to any other property caused by any defect in the product, non-compliance of recommended use or failure to comply with any product warnings.
   (b) Damages based on inconvenience, loss of use of the product and loss of time;
   (c) Any other damages, whether incidental, consequential or otherwise;’
   (d) Any claim against the purchaser by any other party
6. The purchaser must return at their cost, the goods to the point of sale if a claim is made.
7. The laws of the State of Victoria shall apply to the conditions of the sale and Dura-Tarp warranty.

RECOMMENDATIONS:

User is advised to protect tarpaulin from sharp edges, abrasion, wind flap and water pooling. Every eyelet must be secured and where applicable the tarpaulin should be roped over to avoid the “parachute effect”, in doing so tie a rope to at least every second eyelet, passing it over the tarpaulin to the opposite eyelet tying the rope slightly shorter than the tarpaulin at that eyelet. Tarpaulin is not recommended as a temporary roof on open structures which may be subject to strong winds.
